Davis County Court Records

Davis County court records are official materials (such as books, papers, tapes, letters, documents, recordings, plans, maps, films, photographs, and data) prepared, received, owned, or kept by the court (UCJA Rule 4-202.01). The Second Judicial District and Davis County Justice Court maintain these records in compliance with the Utah Court rules and Utah Government Records Access and Management Act (GRAMA). Davis County court records are part of Utah’s larger public records system and may reference vital records, arrest records, and federal court files.

Are Davis County Court Records Public?

Yes. According to the Utah Government Records Access and Management Act (GRAMA), anyone has the right to inspect and obtain copies of court records. The UCJARule 4-202.02 (Code of Judicial Administration) supports this access policy by presuming court records to be public and provides a list of public court records, including:

  • Case files
  • Audit reports
  • Arrest warrants after service
  • Appellate filings
  • Financial records
  • Indexes, opinions, orders, or decisions
  • Administrative office publications
  • Abstract of citations after confidential information has been redacted
  • Name, business telephone number, business address, and business email address of business entity or adult person (excluding those of a party, victim, or witness of a crime)
  • A case party’s name, address, telephone number, birth date, email address, and last four digits of their account number, driver’s license number, and social security number
  • Name, business telephone number, business address, and business email address of a lawyer appearing in a case and of court personnel other than judges

Although court records are public, some records may be restricted to a selected few to protect vulnerable individuals and prevent undue disclosure. Examples of confidential court records in Davis County are adoption, gestational agreement, expunged records, records that reveal the identity of a confidential informant, juvenile court records, and wills deposited for safekeeping.

What Information is Available in Davis County Court Records?

Davis County court records include the whole life cycle of a case, from initial filing to disposition. All courts in Davis County keep official records of all civil and criminal proceedings. The contents of each record vary by case type, but generic information includes the names of the parties, party addresses, assigned judges, attorneys of record, filings, hearings, motions, judgments, and exhibits.

Davis County Court Records Search

Davis County offers several ways of searching and accessing court documents:

  • Online Access: The Xchange Public Search Portal is a subscription-based service that enables the public to access district and justice court records. Another online tool for viewing and copying Davis County court records is the MyCourtCase portal, which is only available to case parties.
  • In-Person Access: Individuals may visit any Davis County courthouse to use the public terminals to conduct court record searches. They may also request assistance from the clerk’s staff with their searches. In-person access is only available during a court’s business hours.
  • Mail and Phone Requests: Mail a completed Request for Court Record form to the court where the case was heard, along with the appropriate copy fees

Fees for Court Records in Davis County

The Utah Code of Judicial Administration 4-202.08 permits the courts in Davis to charge fees for copies of court records.

Paper copies of Davis County court records cost 25 cents per sheet. Electronic copies cost $15 per unit, while fax or email copies cost $5 for 10 pages or less, plus 50 cents per page. In addition to paying the cost of the records, the courts may also charge for staff time. The first 15 minutes of staff time are free. Thereafter, the clerk charges $15 per hour.

Court records available on the Xchange Public Search Portal cost the following fees:

  • A One-Time Use Account: This incurs an initial search fee of $10, with searches costing 35 cents each and documents costing $1 each. These charges will be credited from the first $10 fee. Unused credits from the $10 fee can be reused if the user creates an account.
  • A Guest Account: A $10 fee applies, as with a One-Time Use Account, but users cannot create an account and reuse any remaining credits from the initial $10 fee
  • A Monthly Subscription Account: Users must create an account and set up automatic payments. An initial fee of $25 is required, followed by a $40 monthly subscription fee. This fee covers 500 free searches and $1 per document. After 500 searches in a month, the cost per search is 35 cents until the next billing cycle begins.

Criminal Records Access in Davis County

Davis County Courts lack jurisdiction over statewide criminal history checks. Anyone in need of such records must search in person or by mail through the Utah Department of Public Safety’s Bureau of Criminal Identification (BCI)

Davis County courts only provide access to local criminal case records. Specifically, the district courts hold records for felony offenses and Class A misdemeanors, while the Justice Courts disseminate records for Class B and C misdemeanors, ordinance violations, and infractions. Interested persons may visit any of the local courthouses to view or obtain copies of criminal case records. They may use public access terminals available at the courthouses for their searches or seek assistance from the clerk’s office staff. Another way is to mail a Request for Court Record form to the relevant court clerk’s office to request copies of criminal records.

Individuals can also view criminal records online through the Xchange Public Search portal. Users may access records through the portal by registering an account and paying an initial fee based on the type of account they select. Confidential criminal records are not available on this portal. Case parties may use the MyCourtCase portal to view their case history and access filed criminal case documents at no cost.

Davis County Probate Records

Davis County District Courts handle probate matters, including the administration of estates, wills, trusts, guardianships, and conservatorships.

Accessing Davis County Probate Records:

  • Recent Records: Summary information for more recent estate records, wills, and probate filings is available to the public through the subscription-based Xchange Public Search Portal. This portal provides details like party names, judge names, attorney of record, documents filed, hearings held, judgments entered, and case outcomes.
  • Confidential and Older Records: Confidential records, such as guardianship and conservatorship records, and older probate records, may be obtained in person during the district court’s business hours.

Non-public probate records are accessible only to the parties to the case, their legal representatives, and relevant agencies.

Davis County Family Court Records

Davis County District Courts manage family court records, which document adoption, divorce, and child custody/support cases.

Public family court records are available through the Xchange Public Search portal, which requires a paid subscription. Users must first pay a $25 initial account creation fee. A monthly subscription fee of $40 covers approximately 500 searches. Searches beyond the initial 500 cost 35 cents each until the next billing cycle begins on the first of the following month. Images of family court records can also be purchased from this portal.

Family records can also be viewed in person at the specific district court where the case was heard. The courts provide public terminals for individuals to look up family court cases. A small fee is charged for printing out desired records from these terminals.

Confidential family court records, like adoptions, child welfare, and parental rights termination cases, are not available on the Xchange Public Search Portal or at the public terminals. They can only be retrieved in person at the district courthouses. The court clerk only releases confidential family court records to authorized individuals. Eligible requesters must visit the courthouse during business hours with the required documentation.

Federal Court Records in Davis County

The United States District Court for the District of Utah hears all the federal cases filed in Davis County. These cases include civil disputes involving federal laws, the Constitution, or the U.S. government; cases between citizens of different states with high monetary value; and criminal prosecutions for federal crimes.

Record seekers can access most federal court records online through PACER. They will need to register an account online to access the portal or call (800) 676-6856 for assistance with registration. Downloading court records through the portal costs 10 cents per page. Federal court documents on the portal include civil case dockets from July 1989 and criminal case dockets from November 1992.

Individuals can also visit the federal court clerk’s office for the District of Utah to obtain copies of federal court documents. The clerk’s office is open during regular business hours. Upon arrival at the courthouse, visitors may use the public access terminals to search for records. After locating the appropriate documents, they may print them for 10 cents per page. Requesters may also contact the clerk’s office staff to request copies of federal court records for a fee of 50 cents per page. Large copy orders incur a $34 search fee and require three to five days to process.
